The humble petition of the petitioners above-named Most Respectfully

 

Sheweth:

 

1.                  That the applicant, Smt. Gita Kairi is the wife of Late Siddhi Kairi of Chhoto Jonpur, Naihati, Kampa Chakla, Bijpur, District North 24-Parganas, Pin 741 250, who died intestate on 23/10/2005 leaving behind the applicant and under-mentioned legal heirs and successors.

 

2.                  That the applicant filed the above Act XXXIX Case No. …………… of 2012 before The Learned District Delegate at Barrackpore, District North 24-Parganas.

 

3.                  That the petitioner nos. 1 to 3 are the sons and the petitioner no. 4 is the daughter of said Siddhi Kairi, since deceased and are governed by Hindu Succession Act, 1956.

 

4.                  That the petitioners have no objection, if the instant Succession Case is decreed in favour of the petitioner.

 

5.                  That under the aforesaid circumstances, necessary Orders may be passed so that the instant Succession Case is granted in favour of the applicant.

 

6.                  That the application is made bona fide and for the ends of justice.

 

Under the aforesaid circumstances, Your petitioners most humbly pray that Your Honour may graciously be pleased to grant the applicant the Succession Certificate to collect the total debts plus interest thereon mentioned in Scheduled of Assets hereunder and/or to pass such other further Order/Orders as to Your Honour may deem fit and proper

 

And Your petitioners as in duty-bound shall ever pray.

I, Sri Dinesh Kairi, son of Late Siddhi Kairi, aged about ………… years, by faith Hindu, by occupation ………………………….. of Chhoto Jonpur, Naihati, Kampa Chakla, Bijpur, P. O. Kanchrapara, P. S. Bijpur, District North 24-Parganas, Pin 741 250, do hereby solemnly affirm and say as follows: -

 

1.                  That I am the petitioner no. 3 in the instant case, I am well acquainted with the facts and circumstances of this case and as such I am competent to swear this affidavit on behalf of myself as well as on behalf of the other petitioners.

 

2.      That the statements made in Paragraphs 1 to 5 above are true to my knowledge and I the rest are my humble submissions before This Hon’ble Court.
